During a mediation session, a mediator acts as a neutral party to help disputing persons resolve their differences outside of a courtroom, which can be lengthy and expensive for both sides.
This allows both parties to discuss the case and reach an agreement that best suits their needs. This alternative is so effective that in the state of Nebraska, many separating couples are required to undergo family law mediation as part of their divorce proceedings.

As mediators, we act as a third party neutral in your dispute with another party. You will still be entitled to consult with your attorney, if you have one, as would the other party to the dispute. We have been able to avoid cases going to trial in a number of cases that we have mediated successfully.
When you go to trial on some of these issues, it is a knock down, mudslinging fight. Especially when kids are involved, it can be a harmful process to everyone involved. We take an approach that brings the parties to the table to rationally discuss resolution of the issues and areas of disagreement. You, the parties, get to make the decision as to what happens in the case. When you go to trial, a judge or a jury will determine the outcome.
Lots of times those outcomes don't fit the individual circumstances of the parties, making things all the more difficult once the case is decided. By giving you the power to decide your case, we insure that all voices are heard. We won't make any decisions for you, but will help you communicate to the other side what your needs and interests are in the dispute. We are careful to keep a balanced playing field for both parties so that each of them will have input into the resolution.
We take the time to listen to each party and we facilitate the conversation so that those seemingly impossible cases can be agreed upon by the parties. It is a much healthier and happier way to resolve a case. When both parties have input, they are both more likely to stick to the agreement rather than an order from a judge looking at cold facts. The parties can tailor the agreement so that it fits best with their wishes.
We will not force a settlement on anyone, but more times than not we are able to bring parties to an agreement that they both buy into. An advantage to the mediation process is that both parties can have their attorneys review and sign off on the agreement after it is reached. This again makes sure that both parties are protected.
Remember that mediation is a confidential process so that anything said during the mediation is not allowed to be brought up outside the mediation. The exception to this is child abuse and domestic violence. If those matters were to come up, we would have to report those to the proper authorities. Other than those matters required by law, the mediation is strictly protected. A mediator cannot be subpoenaed to court to testify what happened at the mediation. This provides further protection to the parties.
